LEGAL NOTICE AND TERMS OF USE

The terms and conditions contained in this Legal Notice (hereinafter the “Rules”) are intended to inform, regulate the use and access by users (hereinafter the “User” or “Users”) to all web pages listed under the domain www.hossintropia.com (hereinafter, “the Website”). The Website and its contents are owned and managed by AT LEAST, S.A.

1. Data identifying AT LEAST, S.A.

1.1. AT LEAST is a limited liability company, (hereinafter referred to as AT LEAST), registered in the Companies Registry of Madrid, Page M-133581, Folio 49, Volume 8283, Section 8 of the Companies Book, with tax number (CIF) A-80915804 and registered office at C/ Pantoja 14, 28002 Madrid (Spain), and includes AT LEAST, S.A. and its subsidiaries.

2. Use of the Website.

2.1. By accessing and browsing the Website the User accepts fully and without reservation each and all of the Rules as published by AT LEAST at the moment when the User accesses the page. Therefore, the User must be aware of the importance of consulting the Rules each time the page is accessed.

2.2. The User agrees to use the Website and the services that are made available through the same, in line with the law, morals, good customs and public order, along with the provisions of these Rules.

2.3. AT LEAST may, for greater efficiency in the functioning of the Website and for the benefit of Users, unilaterally modify, at any time and without notice, the content and services provided therein or any other aspect of the Website. Similarly, AT LEAST reserves the right to modify unilaterally and without notice any of the terms and conditions of the Rules, in the terms and conditions that it deems appropriate and these shall have effect from the time of their publication. These changes may be communicated personally to registered Users.

2.4. Users must observe any instructions that are given by AT LEAST, or their duly authorized personnel, via e-mail or the Website.

2.5 AT LEAST provides the User with use of a blog, with AT LEAST reserving the right to publish comments by the Users as well as deleting them wholly or in part without prior notice to the Users. AT LEAST shall not be responsible for the content, comments, expressions and opinions expressed by users of the Blog and which are published therein, nor does it guarantee the accuracy thereof.

The User agrees not to submit content which is defamatory, contains insults or is deemed racist, is obscene, contains religious content, is offensive, or is contrary to existing applicable legislation, and in particular any comments that may violate fundamental rights and public freedoms or that violate the right to honor. The User shall at all times be responsible for the comments posted, being the only guarantor in connection with the enforcement of Intellectual and Industrial Property regulations which may affect the content of the comments which can be seen on the Blog, exempting AT LEAST from any liability regarding the use of such content on the Blog.

3. Protection of personal data of Users by AT LEAST, S.A

3.1. AT LEAST reports that the data that Users provide through the Website shall be included in files owned by AT LEAST, with Users expressly consenting to their collection and treatment, with the aim of maintaining business relationships, receiving information and advertising products and services from AT LEAST, or from third party partners or affiliated companies, either by traditional or electronic channels, and, if providing a curriculum, to be included in the recruitment processes of the company.

3.2. The owner of the data shall be entitled at all times to access the file and to rectify, cancel and contest the same in the terms set out in data protection legislation. Likewise, the consent of the user to the processing and transfer of his/her personal details may be revoked at any moment. This can be done by contacting AT LEAST, S.A. by e-mail at privacy@hossintropia.com or by writing to C/Pantoja nº 14, 28002, Madrid (Spain).

3.3. AT LEAST guarantees the use of appropriate security measures in its facilities, systems and files. Likewise, AT LEAST guarantees the confidentiality of the Personal Details, although it may disclose to competent public authorities both the Personal Details and any other information which may be stored on its files or accessible through its systems, whenever the same is required in keeping with applicable legal and regulatory dispositions.

3.4. Please read our special section regarding the Policy on Data Protection and Privacy that appears on the website http://www.hossintropia.com, as well as in each section where the user is required to enter personal data.

4. Intellectual Property and Copyright.

4.1. All the information contained on the Page, its graphic design and the HTML, JAVA, JAVA Script and Active X language codes are protected by copyright and by other intellectual property rights. These rights are owned exclusively by AT LEAST or its licensees. All Internet users accessing this Page may view the information contained in the same and carry out downloads or private reproductions on their own computer system, provided that the elements reproduced are not subsequently transferred to third parties or installed on a server connected to the Internet or to a local area network. Without prejudice to that set out in the present Rules, any distribution, modification, transfer, public communication, reproduction or any other action partially or wholly involving the information published at the Page is forbidden without prior written authorization from AT LEAST.

4.2. Users must use the content and information on the Page in a diligent, correct and licit manner, specifically for personal non-commercial use, and must not delete or modify the content or any mention of sources, copyright or other data which identify the rights of AT LEAST or third parties, and respecting the original content at all times. Any reproduction or copy, distribution or publication of any kind of the content of the information published at homeless.es without prior written authorization from AT LEAST is strictly forbidden. Authorization for reproduction can be requested by e-mail at contact@hossintropia.com.

4.3. Should any user or third-party consider that any of the content located on the Page has been introduced in the same in breach of copyright or other intellectual property rights, please communicate the said circumstance to AT LEAST using the e-mail address contact@hossintropia.com, with indication of the following: a) Name, address, telephone number and e-mail address of the claimant; b) Details of the owner of the copyright or other intellectual property rights which are deemed to have been breached; c) Indication of the breached content and the location of the same within the Page; d) Declaration that the content has been introduced without express authorization from the owner of the copyright or other intellectual property rights. Without prejudice to that indicated in the preceding paragraphs, AT LEAST reserves the right to defend itself against claims based on current legislation on advertising and copyright or other intellectual property rights.

5. Hiperlinks.

5.1. Whenever the page refers to third-party web sites through advertising links, AT LEAST does not undertake to carry out prior control of the said web sites, nor does it approve or lay claim to the services, content, data, files, products or any other kinds of material contained in the third-party web sites, and in consequence, AT LEAST is in no way liable for the legality of the content of the said web site pages; liability for the same shall correspond, by way of example and without limitation, exclusively to the third-party, who shall make sure the content is legal and in keeping with morality, good conduct and public order and does not breach the rights of other parties. The existence of a hyperlink does not necessarily imply any kind of relationship between AT LEAST and the owner of the web site which is linked to.

5.2. Any users or third parties who wish to establish a hyperlink with the Page must guarantee that the hyperlink only provides access to the pages or services of the Page and does not, by way of example and without limitation, reproduce content, deep-links, browsers or incorrect or inexact statements with regard to the content or the Page. Save for those signs which form part of the hyperlink, the user guarantees that the web page linked to by the hyperlink shall not contain brand names, commercial names, commercial banners, denominations, logos, slogans or any other type of distinctive signs which belong to AT LEAST.

6. Exclusion of Guarantees and Liability.

6.1. AT LEAST, S.A. does not guarantee the reliability, availability or continuance of the operation of its Website nor of the products or services made available to the User, for which reason it is released from any liability for damages of any kind which may derive from the lack of availability, reliability or continuance of its Website or services, although it will, in as far as possible, facilitate technical help to affected persons.

6.2. Within the limits established by law, AT LEAST, S.A. cannot and does not assume any claims deriving from the lack of veracity, integrity and/or updating of the content or information of any kind contained at Website.

6.3. AT LEAST, S.A. does not undertake to carry out prior control with regards to checking for viruses or the existence of elements in the content which may produce alterations in the software or hardware of the Users or person visiting the Website, for which reason it is not way liable for any damages of any kind which may derive from the same.

6.4. The User shall be liable for any damages of any kind which AT LEAST, S.A. may suffer as a consequence of breach by the User of the law or of any of the regulations regarding use as contained in the present Rules.

7. Safeguards for Rules Regarding Use.

Should any of the clauses in the present Rules be declared void or inoperative, the remaining clauses shall be maintained in the terms set out. AT LEAST undertakes to replace any clauses which have been declared void with another clause which is as near as possible to the original intention of the parties.

8. Applicable Law and Competent Jurisdiction.

These Rules are governed by Spanish legislation. In order to resolve any controversy which may come about with regards to the whole or partial validity, execution, breach or termination of the present Rules, AT LEAST and the users expressly subject themselves to the competence of the Courts and Tribunals of the city of Madrid (Spain), with express renunciation of any other jurisdiction which may correspond to them.

PURCHASE TERMS AND CONDITIONS

1. Introduction

In order to safeguard the rights of its Customers in compliance with the Information Society Services and eCommerce Act nº 34/2002, of 11 July 2002, the Personal Data Protection Act Nº 15/1999 of 13 December 1999 and other applicable legislation, AT LEAST S.A. has drawn up the following Purchase Conditions to cover the purchase of articles offered by its eShop on the website http://www.hossintropia.com

This document (hereinafter referred to as "the Conditions") constitutes a commercial agreement that binds both the User (hereinafter “the Customer") and At Least S.A. (hereinafter “AT LEAST”). These Conditions establish the rights and obligations of the Customer and AT LEAST and EXPRESSLY, CLEARLY, COMPREHENSIVELY AND UNAMBIGUOUSLY determines the identity of the proprietor of eShop, the characteristics of the Hoss Intropia articles, their prices, payment conditions, the purchasing process, guarantees, refund policies and any other circumstances regarding the purchase of Hoss Intropia articles.

All Hoss Intropia articles offered by the eShop are sold directly by AT LEAST S.A. with registered corporate address at c/ Pantoja nº 14, 28002, Madrid , Spain, holder of Fiscal NIF nº A-80915804 and of the Hoss Intropia trademark.

By registering with the eShop and making an order, the Customer expressly accepts these Conditions as well as the Data Protection and Privacy Policy and the Legal Disclaimer which can be found on the Web http://www.hossintropia.com. If the Customer does not accept the aforementioned conditions, the order cannot be made. These Conditions may be modified by AT LEAST at any moment without giving prior notice; the Customer should therefore read them before making each order.

Through its eShop, AT LEAST offers its Hoss Intropia articles 24 hours a day, every day of the year. Minors may not make purchases.

2. Registering with the eShop

Registering as a Customer is an essential requirement in order to purchase the Hoss Intropia articles that are offered for sale by the eShop. The personal data that the Customer provides when registering (name and surname(s), address including town/city, postcode and country, delivery address, landline and mobile phone numbers, email address, password, national ID Card or passport number, date of birth and any other observations that the Customer deems necessary when making the order) are entered into our database so that the order may be processed and further purchases made from our eShop. Wherever an asterisk (*) appears on the registration form, the relevant data must be provided by the Customer. Failure to fully and correctly provide such obligatory personal information will prevent Customer registration with the eShop. The questions that do not feature an asterisk are of a voluntary nature, meaning that the Customer may choose not to answer without this having any bearing on his eShop registration. All the personal data that the Customer may provide are subject to our Data Protection and Privacy Policy. The Customer may access his personal data and the information relating to all his orders

The Customer may sign into the eShop using the email and password provided and make purchases. On registering, the Customer may request that the system sign him in automatically by checking the box “Remember me next time”, making the purchasing process easier by permitting a more direct access to his personal data, prior identification no longer being required to access said information. Automatic sign-in is made possible by means of cookies, in accordance with the Data Protection and Privacy Policy. If the Customer has requested automatic sign-in, AT LEAST may only ask the Customer to identify himself if he connects to the eShop or to http://www.hossintropia.com from a computer other than the one they habitually use, or if the temporary Internet files (cache memory and/or cookies) have been deleted.

The email and password are both strictly personal and confidential, it being the responsibility of the Customer to keep them secret. Consequently, the Customer expressly acknowledges that, unless stated otherwise, AT LEAST is entitled to assume that the use of its services and any purchases made using the Customer's account have been made by the registered Customer, unless the Customer informs AT LEAST of the theft of his account details or other improper use of said account, by sending an email to customercare@hossintropia.com

The email and password may be freely modified by the Customer, by means of the procedures established by AT LEAST for such purposes. The old email and password will be cancelled as a means of identification, at the same time as the new information is added.

AT LEAST may block access and use of its website wherever necessary for reasons of security, or as a result of fraud or breach of obligations. If the Customer should make a mistake when entering the password, a notification to this effect will appear, providing a telephone number and/or an email address through which the Customer may request a new password, which will be sent to the user via email.

3.Customer obligations

The Customer must:
Correctly notify AT LEAST of the personal data required in order to register with the eShop. In the event that the Customer does not provide all the obligatory or required information, registration will not be completed and no orders may be made. Adopt the necessary security measures, both personal and material, in order to ensure confidentiality of his password, immediately notify AT LEAST of the loss, theft or unauthorized access of his password and account, and in the event that any unauthorized third parties gain knowledge thereof. Make payment for the Hoss Intropia articles purchased through the eShop and all delivery charges, if applicable. The Customer may not make any fraudulent or otherwise false order. AT LEAST reserves the right to cancel the order and/or notify the relevant authorities in the event that there are reasonable grounds to suspect such fraudulent use. On making an order, the Customer is declaring that he or she is 18 years of age or older and has full legal capacity to do so. Not to undertake any activity that hinders or otherwise interferes with the operations of the eShop.

4.Delivery area.

Hoss Intropia articles may only be delivered in the countries in which our eShops are available (view countries).

Each country will therefore have an eShop which stocks its own articles, has its own prices and may have delivery charges which vary. When entering an eShop, the Customer should select the country to which they wish the purchase to be sent.

5.Purchasing procedure

The Customer must sign into the eShop in order to acquire Hoss Intropia articles, keeping at hand the following information:

a)Description of the article, reference nº, size, characteristics, colour, composition and photograph.
b)Price per unit.
c)Delivery costs.
d)Validity period of the special offer, if applicable

Once the article has been selected, the Customer should add it to the shopping basket by clicking on “ADD TO MY PURCHASES” having specified the size, colour etc. for each article. Once the selected articles have been added to the shopping basket, the Customer may view a summary of the articles selected by clicking on “MY PURCHASES” at the top right of the page, where the order can be changed, articles can be removed, with the following information provided:

b)Description
c)Amount
d)Unit price
e)Total price for each of the selected articles
f)Total purchase price
g)Delivery charges.

When the Customer wishes to finalize the purchase, he should click on the "MAKE PURCHASE" button. If the person making the purchase is a registered Customer, he should provide his email address and his eShop password. If the Customer is not yet registered, he should do so as set out in Section 2 above.

Once the Customer has entered his information, he should select shipping details and may review his delivery and billing details, altering them if necessary.

The Customer then moves on to the “Confirmation and payment” stage of the order. If the Customer has a promotion code or an online voucher he should include it at this point in order to benefit from the conditions and discounts applicable to the purchase. The Customer may send the order as a gift and include a card with a personal message (at the moment this option is not available).

The Customer may then access the payment methods available, entering the relevant details as requested. In order to confirm the purchase, the Customer must accept the Conditions of Purchase, checking the corresponding box and clicking on "Accept".

6. Acceptance of the order

The purchase agreement will not be formalized until the order has been accepted by AT LEAST (although it may already have been debited to the Customer's account). If the order is rejected and the amount has already been debited to the Customer's account, he will be refunded in full within a maximum term of fifteen (15) working days.

After clicking on “PAY", the Customer will receive a confirmation email informing them of the details of the purchase order in question. Failure to receive this message could be due to a temporary network communications problem or to a misspelling of the email address provided for notification purposes. In both cases, the Customer should contact the Company via customercare@hossintropia.com

This email does not imply that the order has been accepted, as this is simply an offer by the Customer to AT LEAST to make a purchase. Orders are subject to AT LEAST's approval and acceptance. Once approval has been granted, an email is sent confirming the order and shipping (Order Confirmation) or its rejection if it is detected that the item of any of the articles included in the order are out of stock .

Only at this point will the Agreement between the Customer and AT LEAST be deemed to have been formalized. Only the Hoss Intropia articles described in the Shipping Confirmation shall be covered under this agreement.

AT LEAST may refuse to process orders which do not provide sufficient guarantees of solvency, or which are incomplete or incorrect, or in the event that the Hoss Intropia articles in question are not available, without this entailing any liability towards the Customer or third parties on the part of AT LEAST. In any event, AT LEAST pledges to notify the Customer if any sum has been charged to his account, and to refund said amount as the case may be.

7. Currency, method of payment and applicable taxes

The prices will be shown in euros or pounds sterling. In accordance with current legislation, all purchases made in the eShop shall be subject to all applicable taxes.

For security reasons, the Customer may not make purchases in excess of 2,000 euros, nor any order containing over 15 articles within a period of fifteen (15) working days. If the Customer wishes to make purchases in excess of these limits, he may contact AT LEAST's Customer Care Service via email: customercare@hossintropia.com

Delivery charges, if applicable, shall be indicated in the purchase summary, prior to payment.

AT LEAST reserves the right to modify prices on the site without prior notice.

The prices of the articles will be those which the eShop stipulates from time to time, except in the event of manifest error. AT LEAST will use its best efforts to prevent mistakes from occurring in the prices indicated on the webpage, however, should there be an error in the price of articles ordered, AT LEAST will notify the Customer as soon as possible giving him the option of continuing with the purchase at the correct price or cancelling the order. If AT LEAST is not able to contact the Customer, the order shall be considered cancelled and all amounts paid shall be fully refunded, without any right to compensation.

AT LEAST will not be obliged to provide the article(s) at the incorrectly listed lower price (even if the Customer has received an order confirmation email) if the error in the price is clear and unambiguous. In this regard, the reference price shall be the price of said Hoss Intropia article in the Hoss Intropia store in the country in which the order is placed, and if not available, in the listed price in the United Kingdom.

AT LEAST accepts payments by credit or debit card (Visa, Visa Electron, MasterCard and Maestro, American Express, Diners) and Pay Pal.

All payments are made through the ADYEN system, a secure payment gateway which encrypts credit card details. In order to ensure maximum payment system security, AT LEAST uses secure payment systems offered by leading eCommerce financial institutions. To this end, the confidential payment details are transmitted directly, SSL encrypted, to the financial institution in question. For payment with Visa and MasterCard, AT LEAST has introduced the SEC (Secure Electronic Commerce) service featuring 3D Secure international protocol which can be identified by the Verified by Visa and MasterCard SecureCode symbols. Secure Electronic Commerce is an initiative which seeks to guarantee security in Internet transactions. By making payment via a secure payment gateway, the system will automatically verify that the credit card is activated for Secure Electronic Commerce. It will next connect to the issuing bank, which will request authorization of the operation through a personal authentication code. The operation shall only be effected if the bank issuing the credit card confirms the authentication code. If not, the transaction will be rejected.

As a complementary measure to the Secure Payment system, and with a view to collaborating in the prevention of Internet fraud, AT LEAST reserves the right to verify the personal information supplied by the Customer and adopt the measures it may deem appropriate (including the cancellation of the order) to ensure that the merchandise in question is delivered in compliance with the details which appear in the order.

8. Availability of articles.

The Customer accepts that the articles offered by Hoss Intropia through its eShop are subject to stock availability. If any Hoss Intropia article is not available once the order has been made, the Customer shall be notified as soon as possible. At this point, the Customer may modify the order or cancel it.

AT LEAST reserves the right to modify the articles on offer in the eShop and their prices at any point without prior notice.

9. Delivery of articles.

At Least sells and ships to the countries listed on the website ( view countries )
The country to which the article(s) are to be shipped must always be the same as the country in which the eShop used by the Customer to make the order is located.
AT LEAST, S.A. offers two shipping methods (Express and standard) and different delivery methods which differ in every country, as detailed bellow:

A) Home delivery: Articles are shipped via a courier company chosen by AT LEAST. Articles The orders will be shipped to the delivery address the Customer provided in his registration details.
The Customer's order will be delivered within a period of time which depends on the delivery method chosen. See summary of delivery timescales and cost bellow.. AT LEAST will use its best efforts to ensure that the service is provided in the shortest time possible (see delivery charges and conditions).

Once the order has been shipped, an email will be sent to the Customer notifying him that his order has been sent.
The orders will be shipped to the delivery address the Customer provided in his registration details, it being important for the Customer to pay close attention when making the order, as it will not be possible to modify the delivery address details afterwards. AT LEAST will not be liable in the event that the delivery address is incorrect or incomplete.

The Customer may monitor the delivery status of his order via the “My Account” section of the eShop, selecting “Monitor order” from within “MY ORDERS”.
For security reasons, AT LEAST will not ship any order to a PO Box number, nor will it accept any order where it is not possible to identify the recipient and his address.
Once the items have been delivered, responsibility for the Hoss Intropia articles will pass to the Customer from that moment onwards.

B) Drop point delivery: The orders will be shipped to a drop point chosen by the customer. Drop points are locations within easy reach of your home or workplace with extended opening hours, or postal offices, where the cusomer can pick up the order. The customer will choose the prefered drop point for the delivery of his order.

The customer will receive a phone message, an email or a phone call as soon as the order arrives to the chosen drop point, and will have to pick up the order at the drop point in the maximum period allowed by the drop point (see maximum pick up periods at their web site). If the customer does not pick up the order within that period, the order will be sent back to our warehouse, and it will be understood the the CLIENT renounces the content, and will not be entitled to demand the refund of his order.

C) Packstation Delivery (Only available in Germany): The order will be delivered to the Packstation chosen by the customer. The customer must be a registered packstation customer. Packstations are automated booths for self-service collection of parcels and oversize letters as well as self-service dispatch of parcels 24 hours a day, seven days a week. Using Packstations is free of charge both for private and business customers, however prior registration is required for collection of parcels. Each customer obtains a magnetic stripe card ("Goldcard") and PIN that can be used to identify the customer at Packstation machines and post offices.
As soon as the parcel arrives at the Packstation, the customer is notified by SMS and will have SEVEN (7) days to collect the package. If the customer does not pick up the order within that period, the order will be sent back to our warehouse, and it will be understood the the CLIENT renounces the content, and will not be entitled to demand the refund of his order.

Note; delivery time refers to working days (excluding weekends) from the moment the order leaves our warehouse.
The Customer's order will be delivered within the delivery time, from the date the order leaves the warehouse. Once the order has been shipped, an email will be sent to the Customer notifying him that his order has been sent.
The orders will be shipped to the delivery address the Customer provided in his registration details, it being important for the Customer to pay close attention when making the order, as it will not be possible to modify the delivery address details afterwards.
The Customer may monitor the delivery status of his order signin in “My Account”, and selecting “Track order” from within “MY ORDERS”.
For security reasons, AT LEAST will not ship any order to a PO Box number, nor will it accept any order where it is not possible to identify the recipient and his address.
Once the items have been delivered, responsibility for the Hoss Intropia articles will pass to the Customer from that moment onwards.

10.Problems with delivery

If an order is not received within ten (10) working days from the date of receipt of the shipping notification, the Customer undertakes to notify AT LEAST of this fact.

When an order is delivered to a Customer, he should check that everything is as ordered. If there is any discrepancy or problem with the order, the Customer should notify AT LEAST via email at customercare@hossintropia.com within a maximum of twenty-four hours from receipt of the order. Said email should indicate the personal details of the Customer and the order number, as well as provide a description of the discrepancy or problem. AT LEAST will contact the Customer as soon as possible in order to resolve the matter.

11.Discount codes

AT LEAST may offer discount codes to its Customers. These codes may only be used for purchases made through the account to which the discounts are applicable.

12. Cancelation, exchange and refund policy.

12.1. Right to cancellation.

Within 7 days of receipt of an order, our Customers may cancel the order in full by sending an email to customercare@hossintropia.com notifying AT LEAST of the cancellation. The Subject line for this email should stipulate: Notification of cancelled order (stating the order number).

After receiving the email cancelling the order, AT LEAST will send the Customer an email with a cancellation number. The Customer should write this cancellation number on the delivery note accompanying the Hoss Intropia articles received. The right to cancellation will be dependent on the Hoss Intropia articles being returned in the same conditions in which the Customer received them, along with their complete and original packaging, labels and any other related accessories.

The only address to which Hoss Intropia articles may returned is AT LEAST (Hoss Intropia) C/ Pantoja nº 14, 28002 Madrid, Spain

AT LEAST recommends that the Customer use a secure method by which to send the cancelled order which may be monitored, as the Customer shall be liable for any damages to the Hoss Intropia articles until they are received at the AT LEAST warehouse. It is also advisable that the Customer keep the delivery receipt corresponding to the cancelled order, in case it may be required at a later date.

After the Customer's cancelled order has been returned to the AT LEAST warehouse, we shall ascertain whether or not the goods have been returned in the same conditions to those in which they were sent. Any Hoss Intropia articles that are returned in a damaged, deteriorated, incomplete, used or dirty state will not be refunded and will be returned to the Customer who will be liable for the corresponding delivery charges.

If the Customer has complied with the conditions foreseen regarding deadlines, notifications and, if appropriate, the conditions of the articles in question, the full amount will be refunded to the Customer within 30 days.

12.2 Exchanges and returns

In addition to your right to cancel your order with us under the distance selling regulations, AT LEAST permits the return or exchange (for the same item in a different size/colour) of the goods in question within FIFTEEN (15) calendar days from the date of receipt.

Whether the client wants to return or exchange the purchase, the following conditions must be fullfilled:

a) Articles must be in perfect condition, in their original packaging and with all labeling. If this is not the case, no exchange or refund will be possible.
b) When returning the product, the Customer should include the delivery receipt provided when the goods were received and the return receipt that can be printed at MY ACCOUNT>MY ORDERS

In order to carry out a refund or make an exchange, the Customer should proceed as follows:

Step 1: Access “My Account” and click “My orders”. Select the order you wish to Exchange and click “Create a return/exchange”

Step 2: Choose the ítem/s that you wish to exchange or return and click “Exchange” or “return”, select a reason for exchange (and your new size or colour) or return.

Step 3: Choose how you prefer to ship your return: You can send the items bak to us using any postal service or you can use our DHL pick up service at a fixed fee that will be deducted from your refund.

Step 4: Choose how you want your refund to be credited. If you opt to receive your refund in store credit, our DHL easy pick up service will appear as marked. We will collect your order free of charge, so the return shipping charges won’t be deducted from your refund. if you choose to be refunded in the same payment method you used to place your order (credit/debit card/paypal), the return shipping charges are on you.

Step 5: Click on “CONFIRM RETURN/EXCHANGE”

Step 6: Print your return receipt that will appear in the following step, where you will find your return number.

Step 7: Place the return receipt together with the item/s you wish to return in the box. Articles must be in perfect condition, in their original packaging and with all labeling. If this is not the case, no exchange or refund will be possible.

Party dresses, lingerie, bathing suits and thights cannot be returned for hygienic reasons.
If the refund method chosen was “credit/debit card”, the refund amount will be made in accordance with the terms and conditions imposed by the Customer's bank. Normally, in the case of payment by credit card, the refund amount is debited at the moment of the settlement and clearance of said amount, however, in the case of payment by debit card, the refund is made within fifteen (30) working days.

Any articles that are returned in a damaged, incomplete, deteriorated, used or dirty state for reasons attributable to the Customer will not be refunded and shall be returned to the Customer who will be liable for the corresponding delivery charges or the article will be made available to the Customer at the warehouse for its collection within a maximum period of sixty (60) days. Once this period has elapsed, it shall be understood that the Customer has waived his claim to said article(s), AT LEAST being released from any liability in this regard. AT LEAST will not be responsible for the safe keeping or deposit of any unduly returned articles while they remain on the premises of the warehouse and shall not be liable for any damage caused thereto

AT LEAST reserves the right to reject any return that does not meet all of the aforementioned conditions

12.3. Returns due to errors in the order. Defective articles

If the Customer receives an order with an error in the size, colour or model of garment, he should contact AT LEAST immediately by email at customercare@hossintropia.com, stating the error and providing all relevant personal details. Once the matter has been analyzed, we shall contact the Customer in order to resolve the supposed error in as short a time as possible.

In the event that the article is defective or shows signs of some imperfection, the Customer should contact AT LEAST as soon as possible by email at customercare@hossintropia.com . Once AT LEAST has received the returned goods, the article(s) in question will be thoroughly examined and an email shall be sent to the Customer within a maximum of five (5) working days confirming the refund or replacement (if applicable). The refund or replacement of the article shall be made as soon as possible and, in all cases, within thirty (30) days subsequent to the date on which the email confirming said refund or replacement was sent, in which case, AT LEAST shall bear all transportation costs of the goods in question. In the event that the article cannot be substituted for another of identical characteristics, the customer will be refunded in full. Refunds shall be made via the same payment channel as used to make the original purchase.

13.Liability and exemption

AT LEAST's liability in respect of any article acquired through http://www.hossintropia.com shall be strictly limited to the purchase price of said article.

Notwithstanding the provisions of the above paragraph and to the extent permitted by law, except where these Terms & Conditions state otherwise, AT LEAST accepts no liability for any indirect damage deriving secondarily from any principal loss or damage, arising in any manner and including any such loss or damage caused by tort or civil wrong (including negligence), breach of contract etc, even in such circumstances where this may have been foreseeable.

All descriptions of articles, information and materials which feature on this website is provided "as is", with no express or implicit guarantees, or any which might be inferred by any other means.

The provisions of this paragraph do not affect the Customer's legal rights as a consumer, nor his right to withdraw from this contract.

14. Events falling outside AT LEAST's control

AT LEAST shall not be deemed liable for any breach of or delay in compliance with any of the obligations established in this agreement which may be attributable to events of force majeure.

Events of force majeure shall include any acts, failures to act, omissions or accidents which may fall outside the reasonable control of the Company, specifically including (by way of illustration but by no means limited to) the following:

Strike, lock out, revolt, invasion or terrorist attack.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic or any other natural disaster.
Impossibility of using of railways, ships, aircraft, motor transport or any other means of transport, either public or private.
Impossibility of using public or private telecommunications systems.
Acts, decrees, legislation, regulations or restrictions imposed by other governments.

15.Protection of Personal Data. AT LEAST's Privacy and Confidentiality Policy

AT LEAST hereby guarantees that all personal data shall be handled in compliance with the Spanish Personal Data Protection Act Nº 15/1999 of 13 December 1999 (LOPD), Royal Decree Nº 1720/2007, of 21 December 2007, approving the Implementing Regulation of the Personal Data Protection Act Nº 15/1999 (RLOPD), and legislation having regard to information society and e-commerce services (LSSICE). To this end, AT LEAST has adopted the appropriate technical and organizational security measures in its facilities, systems and files.

In order to purchase Hoss Intropia articles, Customers will need to provide personal data, all of which must be true, exact, up-to-date and complete. By registering and accepting the purchase conditions, it is deemed that the Customer has been legally informed of and consents to AT LEAST's handling and processing of any personal data provided during registration, information deriving from the use of the service (data obtained from the purchases made), and the results of any IT processes with a view to providing the services requested by the Customer and informing him of the commercial plan. To this end Customer data may be segmented and market studies and profiles may be drawn up, based on the analysis of his purchasing habits, such data processing enabling the application of discounts and promotions and any other special offers which may be made for the benefit of the Customer and to ensure that he receives promotional material, the sending of which by email is expressly authorized by the act of registration.

Data security and the guarantee to protect Customer privacy is of essential importance to AT LEAST. It is therefore advisable that the Customer read our Data Protection and Privacy Policy, applicable to all Customer data, which may be accessed via the above link.

16.Partial Annulment.

If any of these general conditions is declared to be null and void, invalid or inapplicable, this shall not affect the validity or applicability of the other conditions, which shall continue to be binding on the parties appearing herein.

The waiver by any of the parties to demand the compliance at a given time of any of the general conditions stipulated herein shall not imply a general waiver to comply with the other condition or conditions, nor shall it create an acquired right for the other party.

17.Notices

Part of the information or notification sent to the customer shall be in writing and of an electronic nature. The customer therefore hereby grants his consent to use such a method of communication. This condition shall not affect his or her rights as established by applicable law. Such notification shall be understood to have been made in proper form and duly received at the moment at which they appear on the website, 24 hours after the sending of an email or three (3) working days from the postmarked date of any letter.

18.Forum and Applicable Law

These terms and conditions shall be governed by Spanish law. For the resolution of any conflicts, discrepancies or disagreements that may arise in the interpretation and execution of this Agreement, the parties shall submit to the jurisdiction of the Courts and Tribunals of the city of Madrid, Spain.
